Minder was commenced by Bruce Dwyer as a Debt Collection company in 2002. Craig Kennedy who joined Minder in 2007 soon became a partner in the business and is now the overall owner. Debt recovery remains one of its core businesses.
Bruce Dwyer, a former forensic accountant who'd spent most of his life reviving sick companies, many the unfortunate victims of fraud saw a need for his services upon arrival in the Coffs Harbour business community. His initial impression was that the North Coast had the largest population of defaulters in Australia!
Does this sound familiar? The defaulter makes repeated promises to pay before skipping town, or else finds some obscure fault and uses it as a pretext not to pay anything at all.
Not being able to obtain payment on numerous invoices can place a business in serious financial jeopardy. Many having sunk expensive materials, not just their own labour, into the invoiced work. And then there are the one’s who are openly derisive, they say, “take me to court, see if I care!”
Creditors that employ a solicitor to recover their money often find that the legal costs exceed the amount they're chasing.
The present legal system totally fails to protect the small business person from bad debts. John Bracey of the Australian Institute of Private Detectives has made a formal submission to the Federal Government claiming that deficiencies in the current legal systems are costing Australian businesses forty plus billion dollars a year in bad debts. Without doubt our expensive and unwieldy legal system is a major factor in at least half liquidations and bankruptcies.
Minder has joined Bracey in actively lobbying both Federal and State Governments to remedy defective legislation. Company directors of shonky companies shelter behind the company structure, ripping off suppliers at will. Minder challenges ASIC to make "Trading while Insolvent" charges workable under the present legislation. In this and other similar regards ASIC appears a toothless tiger.
Where does all this lead? Simply here. Minder has developed a unique blend of strategies, utilising every legal tool and recovery weapon available to its absolute limit. These include high powered negotiations, covert and focused investigations that often uncover incriminating new evidence, watertight payment by installment systems, lightning fast legal action, the injunction of bank accounts and other monies owed or belonging to the debtor, seizure of assets, garnishee of wages, caveats on properties, court sanctioned and ordered examinations of the debtors assets by Minders own officers and even the arrest of defaulters who fail to turn up at court.
Needless to say Minder's success rate is astonishingly high compared to most solicitors and other debt collection agencies.
The cost? Mostly nothing up front at all. We only charge if we're successful.
